Laning Compensation Act 1973
Davis Blank Furniss – the Manchester based law firm – has completed a case for seven families whose properties were devalued after the opening of Manchester Airport’s second runway in 2001.
The claims were brought under the Land Compensation Act 1973 which compensates individuals for deterioration of the value of property as a result of physical factors arising from public works. Two solicitors – Claire Smith and John Alcock – from Davis Blank Furniss handled the case which involved instructing various experts and counsel – including Leslie Roberts & Co Limited, Jackson Stops & Staff and Acoustic & Engineering Consultants Limited – to determine the value of the potential claims.
In total, more than 300 families in Cheshire had claims against the Airport following the runway’s opening. Five of the claims that were handled by Davis Blank Furniss were settled in August 2010; these had an aggregate value of £148,000 plus costs. However, in September 2010 two of the claims went to trial at the Lands Tribunal and these families were together awarded in excess of £110,000 plus interest and costs.
