We are delighted to announce that we will be staging a free seminar on Tuesday 5th November 2024 with GM Chamber of Commerce tackling the new sexual harassment laws and how businesses can protect their employees and organisations. Shiva Shadi – Head of the Employment team – will be the keynote speaker.
The seminar will cover the points that you need to be aware of and will provide the practical steps that organisations need to take to meet the introduction of the proactive duty on employers to take reasonable steps to prevent sexual harassment in the workplace.
The duty comes into force from 26th October 2024 with employers no longer able to hide behind having a policy in their employee handbook as a defence. The EHRC has also updated technical guidance which now includes a duty to take reasonable steps to prevent sexual harassment not only in respect of employee vs employee but also in respect of third parties sexual harassment too.
We will cover: what constitutes workplace sexual harassment; the special status of sexual harassment, covering the existing employers “all reasonable steps” defence; the new duty on employers to prevent sexual harassment; steps that organisations should take to demonstrate compliance with the new duty.; related grievance/ disciplinary process; and potential damages.
